Terms of service
Effective Date: January 19th, 2025
These Terms of Service ("Terms") govern your use of the Certified Diabetes + Fitness Specialist® credential program and associated services (the "Certification") provided by Certified Diabetes + Fitness Specialists® ("we," "us," or "our"). By enrolling in or accessing the Certification, you agree to these Terms in their entirety.
If you do not agree to these Terms, you may not participate in the Certification.
1. Eligibility
1.1 Participant Requirements:
Participants must:
Be at least 18 years old.
Possess a basic fitness or healthcare certification or equivalent professional experience.
Provide accurate and complete registration information.
1.2 Compliance:
Participants must comply with all applicable laws, professional licensing requirements, and these Terms.
2. Certification Enrollment and Fees
2.1 Enrollment:
Enrollment is subject to acceptance by us. We reserve the right to reject applications at our sole discretion.
2.2 Fees and Payments:
Certification fees are due upon enrollment and are non-refundable, except as specified in Section 6 (Refund Policy).
Payments must be made via approved methods.
2.3 Group Certifications:
Organizations seeking group certification must contact us for custom pricing and terms.
3. Certification Content and Intellectual Property
3.1 Ownership:
All Certification materials, including but not limited to course content, videos, written resources, and logos, are the exclusive intellectual property of Certified Diabetes + Fitness Specialists®.
3.2 License:
Participants receive a non-exclusive, non-transferable license to use Certification materials solely for professional development. Materials may not be reproduced, distributed, or modified without written consent.
4. Certification Completion and Renewal
4.1 Certification Requirements:
To receive certification, participants must complete all required coursework, assessments, and practical demonstrations.
4.2 Renewal:
Certification must be renewed every year. Renewal requirements and fees are subject to change and will be communicated in advance.
5. Code of Conduct
5.1 Professionalism:
Participants must conduct themselves professionally and ethically while representing themselves as certified professionals.
5.2 Prohibited Conduct:
Misrepresenting certification status.
Providing medical advice beyond their scope of practice.
Sharing or reselling Certification materials.
6. Refund Policy
6.1 Eligibility:
Refunds are only available within 14 days of purchase, provided no course modules have been completed or accessed.
6.2 Process:
Refund requests must be submitted in writing to terms@diabetes-fitness.com.
7. Disclaimer of Warranties
7.1 The Certification is provided "as is" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose or non-infringement.
7.2 We do not guarantee specific career or financial outcomes resulting from participation in the Certification.
8. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your participation in the Certification.
9. Termination
We reserve the right to terminate access to the Certification without notice for violations of these Terms or other misconduct.
10. Governing Law and Dispute Resolution
10.1 Governing Law:
The laws of Montana, United States of America, govern these Terms.
10.2 Dispute Resolution:
Unless otherwise required by law, any disputes arising from these Terms shall be resolved through binding arbitration in Montana, United States of America.
11. Amendments
We reserve the right to modify these Terms at any time. Changes will be communicated via email or through the Certification platform. Continued participation after such changes constitutes acceptance.
